No Reason to Bow to the “Supreme Judicial Commander of the U.S. Military”

In September U.S. District Court Judge Virginia Phillips presided over a legal challenge to the 1993 law stating that h omosexuals are ineligible for military service, which is usually mislabeled “Don’t Ask, Don’t Tell.” Having heard the case, brought by the gay activist group Log Cabin “Republicans” (LCR), on October 12 Judge Phillips issued an injunction ordering an immediate worldwide halt to enforcement of the law.

On October 14 the Department of Justice filed an appeal for a stay of the injunction. Earlier this evening Reuters reported that Judge Phillips was prepared to deny the appeal even before she heard arguments today.
